DMA Kingdom - Terms of Service

Introduction
Welcome to DMA Kingdom! By accessing and using our platform, you agree to abide by the terms and conditions outlined in this document. If you do not agree with any part of these terms, please discontinue use of our services immediately.

Terminology
Throughout this document, "User," "You," and "Your" refer to individuals using DMA Kingdom. "Company," "We," "Us," and "Our" refer to DMA Kingdom. "Party" or "Parties" may refer to both the User and DMA Kingdom.

Product Information, Orders, and Hardware Usage
DMA Kingdom provides virtual products, services, and hardware. While we ensure that our hardware meets its intended specifications, its usage is solely at the discretion of the end user. DMA Kingdom has no control over how the hardware is used once purchased, and we are not responsible for any modifications, misuse, or unintended applications by the user. We strive to ensure accurate descriptions and functionality but do not guarantee compatibility with all systems. Orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion.

Payment and Confirmation
By proceeding with a payment, you confirm that you have received and are satisfied with the item as described. Transactions are considered complete upon submission of payment, and any disputes should be addressed promptly in accordance with our refund policy.

Refund Policy
All sales are final and non-refundable, except in exceptional circumstances at DMA Kingdom’s sole discretion.

Returns
If a return is authorized, the buyer is responsible for all return shipping costs. The only form of compensation provided will be financial reimbursement, minus any shipping costs incurred to deliver the original order. Returns will only be accepted if the item is in its original condition and within the timeframe specified by DMA Kingdom. Refund requests must be made directly to an administrator. Due to the nature of virtual products, refunds are not guaranteed and will only be granted under special conditions determined by DMA Kingdom.

Prohibition of Reverse Engineering and Cracking
Users agree not to reverse engineer, decompile, disassemble, or attempt to derive source code or algorithms from DMA Kingdom’s software. Attempting to circumvent security measures will result in immediate termination of access without a refund, and legal action may be pursued.

Limited Warranty for EAC/BE Firmware
We offer a Limited Warranty on EAC/BE Firmware purchased through DMA Kingdom, provided that a safe, determined public firmware is available for the same purpose and value. If issues arise specifically related to the firmware and no safe alternative exists, we will be unable to provide replacements. This limited warranty is non-transferable and applies only to the original purchaser. If a determined safe firmware becomes available, DMA Kingdom reserves the right to terminate the limited warranty.

EAC/BE Firmware Lifetime Warranty

The EAC/BE Firmware is protected by a lifetime warranty, governed by the same terms and conditions as our standard company policies. Please be aware that in the event of significant future development changes, this firmware may be subject to a nominal re-flash fee. This fee would be implemented strictly to help cover a portion of the material and service costs associated with providing the update.

Hardware and Firmware Compatibility Disclaimer

Certain motherboards may not be compatible with the firmware available at the time of purchase or installation. In the event that your hardware is incompatible, you agree that it is your sole responsibility to either replace the hardware or wait until a compatible firmware version is released. Such incompatibility does not constitute grounds for a refund, credit, or return under any circumstances. Refunds may be permitted but its at our sole discretion so please contact Devious128 on discord or the support team on the forum! These would only be accepted if no fw has been received or DNA id hasn't been submitted.

Compatibility and Support Acknowledgment
Users acknowledge that compatibility issues may arise and that our software may not function on all system configurations. If an issue is determined to be unrelated to DMA Kingdom’s software, we may be unable to provide additional support, replacements, or refunds.

Shipping
We aim to dispatch all orders within 14 business days. Shipping times may vary based on your location. We are not responsible for any delays caused by the shipping carrier.

We understand that timely delivery is crucial for our customers. However, please note that DMA Kingdom does not directly control shipping rates or delivery times. These are determined by third-party shipping vendors we partner with to ensure your order reaches you safely. While we strive to work with reliable carriers, delivery times may vary based on the vendor, your location, and other factors beyond our control. We recommend checking the tracking information provided to stay updated on your order's progress.

Taxes
The buyer is responsible for all import duties, taxes, and fees imposed by the destination country. These charges are not included in the item price or shipping cost and must be paid by the buyer directly to the customs authority or the relevant courier service. Failure to pay these fees may result in delays or non-delivery of your order. Orders that fall under these circumstances will not be eligible for compensation.

Leaving the Server

Voluntary Exit: You may leave our Discord server at any time by selecting the leave server option.

Bans and Suspensions: Members who violate our guidelines may be subject to temporary or permanent bans at our discretion. Depending on the severity of the violation, bans may be appealed or deemed final. Repeated infractions or serious breaches of our terms will result in immediate and non-reversible removal from the community.

Community Guidelines

Respectful Interaction: We expect all members of our Discord community to interact respectfully and courteously with one another. Harassment, hate speech, and abusive behavior will not be tolerated.

Privacy: Do not share personal information publicly on the Discord server. Use direct messages for sharing sensitive information related to your orders or support requests.

Compliance: All members must comply with Discord's Terms of Service and Community Guidelines.

Support and Contact Information
For inquiries and assistance, please reach out to DMA Kingdom support through our dedicated Discord Server. While we aim to provide timely support, response times may vary based on staff availability.

Limitation of Liability
In no event shall DMA Kingdom or its representatives be liable for any direct, indirect, incidental, or consequential damages arising from the use of our platform or products.

Changes to Terms
DMA Kingdom reserves the right to modify these terms at any time. Users are expected to review this document regularly to stay informed of any changes.

SMS:

By consenting to DMA Kingdom's SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase.

If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within our messages. You understand and agree that the primary method for opting out of our SMS program is to reply with specific keywords (such as ‘STOP,’ ‘END,’ ‘UNSUBSCRIBE,’ ‘CANCEL,’ or ‘QUIT’), or to use the unsubscribe link provided. We will also honor any other requests that clearly express your desire to opt out, including phrases like ‘please opt me out.’ We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

We have the right to modify any telephone number or short code we use to operate the service at any time. You will be notified on such occasions. You agree that any messages you send to a telephone number or short code we have changed, including any STOP or HELP requests, may not be received, and we will not be liable for honoring requests made in such messages.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Arbitration and Class Action Waiver Agreement:

1. Arbitration:

By using or purchasing DMA Kingdom's products or services, you agree that any controversy, claim, action, or dispute between you and DMA Kingdom arising out of or relating to: (a) these Terms, or the breach thereof; or (b) your access to or use of DMA Kingdom's website or the services or the materials; or (c) any alleged violation of any federal or state or local law, statute or ordinance (each such controversy or claim, a “Claim”), shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association in accordance with its applicable rules.

Arbitration is a form of dispute resolution in which parties agree to submit their disputes and potential disputes to a neutral third person (called an arbitrator) for a binding decision, instead of having such dispute(s) decided in a lawsuit, in court, by a judge or jury trial. The arbitrator is obligated to issue a reasoned award in writing, including all findings of fact and law upon which the award was made. The arbitrator shall not have the power to commit errors of law, and the arbitrator’s award may be vacated or corrected through judicial review by a court of competent jurisdiction. Each party’s attorneys’ fees, expert costs, and other costs and expenses incurred in connection with arbitration will be borne by the party incurring such costs and expenses.  

  1. Arbitration Procedures:

Claims shall be heard by a single arbitrator. Arbitrations shall be held in the United Kingdom, but the parties may choose whether to appear in person, by phone, or through the submission of documents.  The arbitration shall be governed by the Federal Arbitration Act (“FAA”) and by the internal laws, without regard to conflicts of laws principles. Any disputes in this regard shall be resolved exclusively by an arbitrator. If, but only if, the arbitrator determines the FAA does not apply, New York law governing arbitration agreements will apply. All disputes with respect to whether the foregoing mutual arbitration provisions are unenforceable, unconscionable, applicable, valid, void or voidable shall be determined exclusively by an arbitrator, and not by any court.

  2. Exclusion from Arbitration:

Notwithstanding the terms of this Arbitration Agreement, you may choose to pursue a Claim in court and not by arbitration if you opt-out of these arbitration procedures within 30 days from the date that you first purchase any of DMA Kingdom's products or services (the “Opt-Out Deadline”). You may opt out by mailing a written notification to dmakingdom1@gmail.com.  Your written notification must include (1) your name, (2) your address, and (3) a clear statement that you do not wish to resolve disputes through arbitration. Your decision to opt-out will have no adverse effect on your relationship with DMA Kingdom. You are responsible for ensuring DMA Kingdom's receipt of your opt-out notice, and you therefore may wish to send a notice by means that provide a written receipt.  Any opt-out request received after the Opt-Out Deadline will not be valid and you must pursue your Claim in arbitration.

2. Class Action Waiver:

You and DMA Kingdom agree that you may bring or participate in Claims against DMA Kingdom only in your respective individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.  Unless both you and DMA Kingdom agree otherwise in writing, the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated and may not otherwise preside over any form of a representative or class proceeding. Notwithstanding any other clause contained in this Agreement, any Claim that all or part of this Class Action Waiver is unenforceable, unconscionable, void or voidable may be determined only by a court of competent jurisdiction and not by an arbitrator.
